Terms of Use

1. Agreement

These Terms of Use (“Terms”) are an agreement between you and MAM SOFTWARE SERVICE LIMITED (“we”, “us”), the publisher of the Rest app (“Rest” or the “App”). By downloading or using Rest, you agree to these Terms and to our Privacy Policy. If you don't agree, please don't use the App.

2. What Rest does

Rest uses Apple's Screen Time framework to notice when your visit to the apps you choose runs past a limit you set. It then shows a gentle shield and suggests a short reset, such as a walk. You can unlock, skip or change your settings at any time. Rest needs Screen Time access to work. Health, Motion and notifications are optional.

3. Not medical advice

Rest is designed for general wellbeing. It is not a medical device and does not diagnose, treat or prevent any condition. Figures in the weekly summary, such as steps, sleep and workouts, are patterns in your own data, not medical assessments or promises of any outcome. Talk to a qualified professional about any health concern, and before starting new physical activity if you have a medical condition.

4. Your safety

When Rest suggests a lap, only walk where and when it is safe to do so. Stay aware of your surroundings. Never use Rest in a way that distracts you while driving, cycling or operating machinery. If walking isn't right for you, choose “Phone down” in Settings. You are responsible for your own physical activity.

5. Subscriptions and billing

• Rest is free to download and needs an active subscription to work. Plans and prices are shown in the App before you buy and may vary by region.
• Payment is charged to your Apple ID when you confirm the purchase.
• Subscriptions renew automatically unless you turn off auto-renew at least 24 hours before the end of the current period. Your account is charged for renewal within 24 hours before the period ends.
• If a free trial is offered and you're eligible, any unused part of the trial ends when you buy a subscription.
• You can manage or cancel your subscription in your App Store account settings. Cancelling stops future renewals; you keep access until the end of the period you've paid for.
• Refunds are handled by Apple under its policies. You can request one at reportaproblem.apple.com.
• If your subscription ends, Rest stops watching and lifts every shield. Your settings stay on your device.

6. Licence

We grant you a personal, non-exclusive, non-transferable, revocable licence to use Rest on Apple devices that you own or control, as permitted by the Usage Rules in the Apple Media Services Terms and Conditions. You may not copy, modify, reverse engineer, resell or redistribute the App, or use it to break any law.

7. Our content

Rest, including its design, text, graphics and the character Pim, belongs to us or our licensors and is protected by intellectual property laws. These Terms don't transfer any of those rights to you.

8. Availability and changes

Rest depends on Apple services such as Screen Time, which Apple may change or limit. We work to keep Rest reliable but can't promise it will always be available, uninterrupted or error-free, or that every tap will fire. We may update, change or discontinue features.

9. Disclaimer

To the fullest extent permitted by law, Rest is provided “as is” and “as available”, without warranties of any kind, whether express or implied, including fitness for a particular purpose. Some jurisdictions don't allow certain warranty exclusions, so parts of this section may not apply to you.

10. Limitation of liability

To the fullest extent permitted by law, we are not liable for any indirect, incidental, special or consequential damages, or for any injury or loss arising from your physical activity or your use of the App. Our total liability for any claim relating to Rest is limited to the amount you paid for the App in the 12 months before the claim. Nothing in these Terms limits liability that cannot be limited by law.

11. Apple

You and we acknowledge that:

• These Terms are between you and us only, not with Apple Inc. (“Apple”). We, not Apple, are solely responsible for Rest and its content.
• Apple has no obligation to provide maintenance or support for Rest.
• If Rest fails to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price, if any. To the maximum extent permitted by law, Apple has no other warranty obligation regarding Rest. Any other claims, losses, liabilities, damages, costs or expenses due to a failure to conform to a warranty are our responsibility.
• We, not Apple, are responsible for addressing any claims by you or a third party relating to Rest, including product liability claims, claims that Rest fails to meet legal or regulatory requirements, and claims under consumer protection, privacy or similar laws.
• If a third party claims that Rest or your use of it infringes their intellectual property rights, we, not Apple, are responsible for the investigation, defence, settlement and discharge of that claim.
• You represent that you are not located in a country subject to a U.S. Government embargo or designated as “terrorist supporting”, and that you are not on any U.S. Government list of prohibited or restricted parties.
• You must comply with any applicable third-party terms when using Rest.
• Apple and its subsidiaries are third-party beneficiaries of these Terms and, once you accept them, may enforce them against you as a third-party beneficiary.

12. Ending these Terms

You can stop using Rest at any time by deleting the App and cancelling your subscription. We may suspend or end your licence if you seriously breach these Terms. Sections that by their nature should survive (such as 9, 10 and 13) continue after termination.

13. Governing law

These Terms are governed by the laws of the United Arab Emirates as applied in the Emirate of Dubai. Disputes will be subject to the exclusive jurisdiction of the courts of Dubai, unless the mandatory consumer protection laws of your country of residence give you the right to bring a claim in your local courts.

14. Changes to these Terms

We may update these Terms. If we make a material change, we'll update the date above and let you know in the App. Continuing to use Rest after a change means you accept the updated Terms.
